Uploading and Posting Content
Responsibility for Content: You are entirely responsible for all content that you upload, post, or otherwise transmit via RubyGrab. You agree not to upload, post, or otherwise transmit any content that is:
- Inaccurate, harmful, obscene, pornographic, defamatory, racist, offensive, harassing, or otherwise objectionable;
- Represents printable 3D models which are replicas or realistic depictions of weapons;
- Includes unauthorized disclosure of personal data such as images or personal information;
- Violates or infringes anyone’s intellectual property rights;
- Contains software viruses or any code designed to disrupt the functionality of any software or hardware.
RubyGrab’s Rights: RubyGrab reserves the right to edit or remove content that violates these terms or is otherwise deemed inappropriate. We do not claim ownership of your content but require your permission to use it as needed for the operation of the site.
Licensing of Content: By posting content on RubyGrab, you grant a non-exclusive, worldwide, royalty-free license to us and other users of the site to use, reproduce, modify, and distribute your content. This includes the right to make your content available as part of our database and to use it for promoting RubyGrab and its services.
Product Listing and Ownership
- Ownership and Control: Artists and designers (Sellers) are solely responsible for the digital goods they list on RubyGrab. RubyGrab does not claim ownership over these products and is not involved in the creation, description, or storage of the digital content.
- External Hosting of Digital Goods: Sellers must link to an external cloud storage where the digital goods are stored as ZIP files. RubyGrab does not host these files directly and has no control over or responsibility for the content of these ZIP files.
- License Obligations: It is the responsibility of the seller to include a license file in each product package. RubyGrab does not provide licenses for the use of digital goods sold on the platform.
Dispute Resolution and Complaints
- Complaints Handling: Any complaints regarding the products sold should be directed to the product owner (Seller). RubyGrab facilitates communication between the buyer and the seller but is not responsible for resolving any disputes.
- Reporting Concerns: Users may report concerns about a product by filling out a form provided on RubyGrab Contact page. RubyGrab will review these concerns and may take appropriate action including but not limited to removing the product from the site.
Process of Purchases and Payments
Marketplace Facilitation: RubyGrab facilitates interactions between buyers and sellers by providing a marketplace platform. RubyGrab is not a party to the product purchase agreements between buyers and sellers. Instead, payment transactions related to product purchases are conducted from the buyer to the seller through RubyGrab.
Role of RubyGrab: In connection with these payment transactions, RubyGrab is authorized to conclude the sale of goods on behalf of the seller only. RubyGrab acts as each seller’s payment collection agent solely for the purpose of accepting and processing orders and payments on behalf of the seller(s) from the buyer(s). RubyGrab’s duties and authority are limited to these actions. Receipt of orders and payments by RubyGrab from the buyer shall fulfill the buyer’s obligations under these terms.
Independence in Transactions: Decisions to purchase a product and arrange payment are made by the buyer independently and in a principal capacity. RubyGrab undertakes no fiduciary, implied, or otherwise further duties or functions on behalf of the buyer other than those detailed in the General Terms. RubyGrab does not represent the buyer in any capacity in relation to payment transactions.
Payment Processing: Each seller agrees that payment made by a buyer through RubyGrab is considered equivalent to a payment made directly to the seller. Sellers acknowledge that payment to them by RubyGrab is conditional upon successful receipt of the associated payments from the buyer. By appointing RubyGrab as a limited payment collection agent, sellers agree that RubyGrab assumes no liability for any acts or omissions of the seller.
Indemnity: Both buyers and sellers agree to indemnify and hold RubyGrab harmless from any losses incurred as a result of acting as an intermediary service provider and payment collection agent. Sellers authorize RubyGrab to collect payments from buyers and distribute the payments to sellers, tax authorities, or other entities as required under this agreement and in compliance with legal regulations.
Limitation of Liability
RubyGrab and its affiliates, officers, shareholders, partners, representatives, agents, and employees will not be liable for any indirect, punitive, special, incidental, exemplary, or consequential damages, or any damages whatsoever (including, without limitation, damages for loss of use, data, information, profits, or business interruption), arising out of or in any way related to:
- The use or performance of this site or any linked website.
- Any content or other materials obtained through this site, or otherwise arising out of the use of this site.
- Any decision made or action taken by you in reliance on any information, advice, or materials provided on this site, whether based in tort, contract, negligence, strict liability, or otherwise, even if RubyGrab has been advised of the possibility of such damages.
Your sole remedy is to discontinue using this site. Some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, so some of these limitations may not apply to you.
No Warranty
- RubyGrab operates solely as a forum for the exchange of digital products’ licenses. It does not control the quality or legality of any content on the site or the accuracy of any related information.
- It is entirely your responsibility to ensure and evaluate the quality, legality, and appropriateness of any content you choose to use. RubyGrab will not be liable for any misrepresentation, incomplete statement, or failure to disclose any content data, nor for any claims arising from a transaction resulting from your use of the site.
- The site and all content are provided on an “as is” basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
- RubyGrab disclaims any warranty that the site will meet your requirements or that the site will be uninterrupted, timely, secure, or error-free, or that defects, if any, will be corrected.
- RubyGrab is not responsible for any content’s timeliness, deletion, misdelivery, or failure to store any user communications or personalization settings.
- No advice or information, whether oral or written, obtained by you from RubyGrab or through the site, shall create any warranty not expressly stated in the terms.
- RubyGrab will not be liable for any delays in the delivery of content or performance caused by factors outside of its control.
